Abstract

Although section 107 of the Copyright Act specifies that “news reporting” is one of the uses of a copyrighted work that may be fair, the current application of the fair use doctrine poses unique difficulties for journalism defendants. This Article argues for several changes in fair use analysis to make the doctrine flexible for journalism defendants. This Article also argues that these changes are necessary to keep the Copyright Act in balance with the First Amendment.
