Abstract

The purpose of this Article is to highlight the importance of a mandatory Alternative Dispute Resolution (ADR) program and the creation of a U.N. arbitral tribunal for the effective enforcement of international human rights under HOPE II. This Article examines the legal barriers to the development of the Rule of Law and international human rights in Haiti. Using William Ewald’s logic of legal transplants, it does not confine itself to an investigation of a single, present-day legal system, but also contains a substantial historical overview. In light of this approach, this Article will first discuss the main historical factors associated with the current international human rights crisis in Haiti.
