Abstract
This note first surveys the benefits and burdens offered by gray market importation to all parties concerned. Part II briefly outlines the functions of a trademark. Part III addresses the development of the gray goods issue in both the courts and Congress, discussing the relevant statutes and regulations around which the basic conflict over gray market importation centers. Finally, Part IV considers several alternative solutions to the conflict, taking into account the rights and interests of the domestic trademark owner, the gray market importer, and the American consumer.
