Abstract
This essay is part of a continuing effort to identify potential problem areas that the drafters of the U.N. Convention on Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment failed to anticipate. The intention is to confront and resolve legal ambiguities which could be utilized by States to circumvent their obligations as signatories to the Convention.
