Abstract

Professor Gordon’s hypothetical fact situation touches upon a wide variety of problems ranging from tort and contracts principles to the law of conflicts and public international law. Leaving aside the substantive issues, let me tackle those within my sphere of competence. I shall address them in chronological order following the sequence in which they would present themselves to counsel charged with planning and litigating international transactions.
